📜 Terms of Service

1. Definitions

• "SEC Dispatch" — SEC Dispatch, LLC and its operators.
• "Carrier" — You, the motor carrier with valid MC/USDOT authority contracting our services.
• "Broker" — Third-party freight brokers who post and negotiate loads.
• "Services" — Load matching, rate negotiation, paperwork handling, and related administrative dispatch support.
• "Flat Rate" — $200 USD per successfully brokered load, due within 15 business days of load delivery.

2. Service Description

SEC Dispatch provides administrative dispatch services for owner-operators and small fleet carriers. Our services include:

• Searching load boards (DAT, Truckstop, 123Loadboard) for loads matching your equipment and preferred lanes
• Negotiating rates with brokers on your behalf
• Handling paperwork including BOLs, rate confirmations, and invoicing
• Pursuing detention, layover, and TONU pay claims
• 24/7 phone and text support for load-related issues

We do NOT: own equipment, hire drivers, handle payroll, or act as a transportation broker. All loads are booked under your MC number and authority.

3. Fees & Payment

• Flat Rate Fee: $200 USD per load. No percentage commissions. No hidden fees.
• Payment Due: Within 15 business days of the load being delivered.
• Payment Methods: ACH transfer, Zelle, Cash App, or QuickPay via factoring company.
• No Upfront Fees: We do not charge sign-up, monthly, or subscription fees.

4. SMS & Messaging Terms (TCPA Compliance)

By providing your phone number and opting in, you consent to receive SMS messages from SEC Dispatch. These terms supplement our Privacy Policy:

• Voluntary Consent: SMS consent is separate and independent from dispatch service agreements. Consent is never required to access our website or download guides.
• Message Types: Load alerts, rate updates, dispatch tips, account notifications, and occasional marketing.
• Frequency: 3–10 messages per week, depending on market activity.
• Opt-Out: Text STOP anytime. After STOP, you will receive one final confirmation.
• Re-Opt-In: Text START or submit the SMS consent form again.
• Help: Text HELP for assistance, or call (980) 327-1788.
• Carrier Rates: Message and data rates may apply.
• Privacy: We do not share your phone number for third-party marketing.

5. Liability Disclaimer

• SEC Dispatch is NOT liable for load failures, broker defaults, cargo damage, fuel costs, or force majeure events.
• Carriers are responsible for inspecting loads, securing freight, and ensuring equipment is road-legal.
• Rate estimates and market averages quoted by SEC Dispatch are informational and not binding guarantees.
• SEC Dispatch provides administrative support only; final dispatch and operational decisions rest with the carrier.

6. No-Contract Policy

Unless otherwise agreed in writing, our services are offered on a per-load basis with no long-term commitment. Either party may discontinue services at any time without penalty, subject to payment of any outstanding flat-rate fees for loads already delivered.

7. Governing Law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict-of-law principles.

8. Changes to These Terms

We may update these Terms from time to time. The most current version will be posted at secdispatch.com/terms with the effective date. Continued use of our services after changes constitutes acceptance.
